Police in New York are investigating the cause of a collision that left an elderly woman fighting for her life. This pedestrian accident occurred Wednesday, Aug. 16, in the Tribeca area. Authorities say that the victim was crossing Franklin Street when she was struck.
According to reports, at approximately 12:30 p.m., an 88-year-old female was hit by a dump truck. The truck driver was apparently attempting a left-hand turn when the vehicle hit the woman. The victim was promptly transported to Bellevue Hospital and is in critical condition. She is said to have suffered an injury to her leg as well as other serious injuries. There have not been any updates regarding her current condition.
The dump truck is the property of Gencar Trucking. The driver reportedly stayed at the scene following the incident and is said to be cooperating with police. As of the latest report, no arrests or charges have been filed in this case. It is unclear if any charges are expected.
Determining fault following a pedestrian accident is not always easy. There are a lot of factors involved in such incidents, all of which must be examined. If, in this case, the truck driver is thought to have been negligent in his actions leading to the collision, the victim or — in the event of fatality – her family members may be entitled to pursue compensation for any losses sustained by filing civil claims against him and possibly his employer. An experienced attorney would be able to perform a full case review and, if it is deemed appropriate, assist in filing and litigating any applicable claims in a New York civil court.
