Drivers in New York are generally responsible for the safety of their passengers and others in or near the roadway. Unfortunately, some drivers ignore that obligation. Disobeying the rules of the road can lead to a fatal accident for which the driver can be held responsible.
This may be the fate of a 25-year-old driver whose alleged failure to yield had devastating consequences. The accident reportedly occurred in Jefferson County on a recent afternoon. Troopers recorded that the car driver — with three passengers — was northbound when he turned left at an intersection, directly into the path of a southbound pickup truck.
The impact of the collision apparently caused the vehicles to roll over several times. A 15-year-old passenger was reportedly airlifted with serious internal injuries and multiple fractures, while another passenger was transported to a hospital with injuries reported to be non-life threatening. The third passenger, a 21-year-old woman in the front seat, suffered fatal injuries at the accident scene. No mention was made of any injuries suffered by the drivers of the two vehicles. An accident investigation to document the circumstances of the crash is underway.
Any person who suffers injuries in a car accident caused by the negligence of another party is entitled to pursue a claim for financial relief to cover medical costs and other monetary losses. When a fatal accident occurs, the deceased victim’s surviving family members may seek recovery of end-of-life expenses and other damages allowed under New York law. Whether through a personal injury or a wrongful death claim, proper proof of negligence that is found to have caused an accident resulting in injury or death may result in the entry of a monetary judgment for documented financial damages.
